1. Agreement to Terms

Welcome to OhMyDays ("App", "we", "us", or "our"). By downloading, installing, or using the OhMyDays mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

OhMyDays is a mobile application that helps you track important dates through counters. The App offers:

• Create and manage counter events for future and past dates
• Add photos from your gallery, Unsplash, or gradient backgrounds to events
• Add and update notes to events
• View events in weekly, monthly, and yearly view
• Home screen widgets to display counters
• Organize events by categories

2.1 Free Version

The free version of OhMyDays includes:

• Create up to 5 events
• Single photo per event
• Basic widgets (single event display)
• Share counter cards with watermark

2.2 OhMyDays Pro

OhMyDays Pro is a premium subscription that unlocks additional features:

• Unlimited events
• Advanced event settings (repeats, end date, timezone, working days)
• Multiple photos per event
• Multi-event widgets
• Custom fonts
• Custom categories
• Display formats
• Share a copy of event via link
• Watermark-free sharing

3. Eligibility

OhMyDays is available for users of all ages. The App does not collect personal information or require account creation, making it suitable for family use.

If you are under 18, you should review these Terms with a parent or guardian.

4. Premium Subscriptions

4.1 Subscription Options

OhMyDays Pro is available through the following subscription options:

• Monthly Subscription: Billed monthly
• Yearly Subscription: Billed annually (best value)
• Lifetime Purchase: One-time payment for permanent access

Current pricing is displayed in the App. Prices may vary by region and are subject to change.

4.2 Billing and Payment

• All purchases are processed through the Apple App Store
• Payment is charged to your Apple ID account upon confirmation
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Cancellation

• You may cancel your subscription at any time through your Apple ID account settings
• Cancellation takes effect at the end of your current billing period
• You will retain Pro access until the end of the paid period
• No partial refunds are provided for unused portions of a subscription period

4.4 Refunds

Refund requests are handled by Apple according to their App Store policies. To request a refund, visit reportaproblem.apple.com or contact Apple Support.

5. User Content and Conduct

5.1 Your Content

You retain ownership of all content you create in OhMyDays, including:

• Event titles and descriptions
• Photos you add to events
• Custom settings and preferences

This content is stored locally on your device. When you use the "Share a Copy" feature, event details and a compressed photo are temporarily uploaded to our servers for up to 12 hours to enable sharing via link. This data is automatically deleted after expiry. By using the Share a Copy feature, you grant us a limited, temporary licence to store and serve this content for the purpose of enabling the share functionality.

5.2 Photo Usage

When you add photos to events:

• You confirm you have the right to use those photos
• Photos are stored locally within the App
• Shared counter cards may include your photos
• Images selected from Unsplash are provided under the Unsplash License and are subject to its terms

5.3 Acceptable Use

You agree not to use OhMyDays to:

• Violate any applicable laws or regulations
• Infringe on the rights of others
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's functionality
• Use automated systems to access the App
• Redistribute or resell the App or its content

6. Intellectual Property

6.1 Our Intellectual Property

We own all rights to:

• The OhMyDays name, logo, and branding
• App design, user interface, and visual elements
• Software code and technical implementation
• Gradient backgrounds and design assets
• Share card templates and layouts

These elements are protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal devices
• Use the App for personal, non-commercial purposes
• Create and share counter cards for personal use

6.3 Restrictions

You may not:

• Use OhMyDays branding without permission
• Create derivative works based on the App
• Use the App or its outputs for commercial purposes without authorization
• Remove or alter any copyright or trademark notices

7. Widgets

OhMyDays provides home screen widgets subject to these conditions:

• Widgets are provided as a feature of the App
• Widget functionality depends on iOS capabilities and may change with system updates
• Widget refresh rates are controlled by iOS to optimize battery life
• We cannot guarantee specific widget update frequencies

8. Disclaimers

We do not warrant that:

• The App will be uninterrupted or error-free
• Defects will be corrected
• The App is free of viruses or harmful components
• The App will meet your specific requirements

9. Limitation of Liability

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding any claim.

Some jurisdictions do not allow limitation of liability for certain damages, so some of these limitations may not apply to you.

10. Data and Backups

Important information about your data:

• All data is stored locally on your device
• We do not have access to your data and cannot recover it
• You are responsible for backing up your device
• Deleting the App will permanently remove all app data
• Data may be included in your iCloud or iTunes backups
• When using "Share a Copy", event data and photos are temporarily stored on Firebase (Google Cloud) servers for up to 12 hours, after which they are automatically deleted

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle information. By using OhMyDays, you acknowledge and agree to our Privacy Policy.

12. Changes to the App

We reserve the right to:

• Modify, update, or discontinue features at any time
• Release new versions with different functionality
• Change subscription pricing (with notice to existing subscribers)
• Discontinue the App entirely (with reasonable notice)

13. Changes to Terms

We may update these Terms from time to time. When we do:

• We will update the "Last Updated" date at the top
• Material changes will be communicated through app updates
• Your continued use after changes constitutes acceptance

We encourage you to review these Terms periodically.

14. Termination

You may stop using OhMyDays at any time by deleting the App from your device.

We may terminate or suspend your access to the App if you violate these Terms, without prior notice or liability.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Australia.
